Dear the Airmap Service Provider and to whom concerned

As a newbie on drones, I have flown MAVIC Air 2 made by DJI. I was told by my colleagues that the Airmap service and the app provided by your company will let me get information regarding drone aviation such as the rules when flying drones. I have looked up on the web and found out that your Airmap service is most reliable and the world's biggest software for drone flyers such as myself.

저는 드론 초보자로서 DJI에서 만든 MAVIC Air 2 드론을 날려 본 적이 있습니다. 저는 제 동료들로부터 드론을 날릴 때 귀하의 회사에서 제공하는 에어맵 서비스를 드론을 날릴 때 적절한 정보를 얻을 수 있다며 사용하라고 권유받았었습니다. 인터넷에서 찾아보니 귀하의 에어맵 서비스가 저와 같은 드론 사용자들을 위한 가장 믿을 만하고 세계에서 가장 큰 소프트웨어라는 것을 알게 되었습니다.

Last week, while I was exploring Korean news channels, I happened to read an article about your company's app, "AirMap for Drones". I was caught by surprise and disappointment of the contents of the news article. The main subject of the article was about an error that Airmap provides, regarding a Korean island. To be more specific, the error was about a Korean island called Dokdo (approximately in 37°14′31″ North, 131°51′52″ East). If you search 'Dokdo' and the coordinates provided above on the "AirMap for Drones" app, the 'Rules/Advisories' tab describes that the drone flyer (on Dokdo island) is required to find information and check on Japan's drone flying area, even though the Dokdo island belongs to Republic of Korea.

From a common-sense standpoint, this is obviously an error. It is hard to understand that Japanese data must be checked and one should be approved by the Japanese government in order to fly a drone in Korean airspace, which is the sky above the territory of the Republic of Korea. Korean Air space (also called Aerial Domain) includes Dokdo area. As from the Constitution of the Republic of Korea Article 3, it says that ‘The territory of the Republic of Korea shall consist of the Korean peninsula and its adjacent islands.’ There is no doubt that Dokdo’s air space belongs to Korean sovereignty. Therefore, I am very concerned that the description on your app may seem like your company and product do not recognize Republic of Korea's territorial sovereignty.

When I looked for Korean laws and regulations that should be referred to when operating drones in Korea, it said that in order to launch a drone on Dokdo island, only the approval of the First Fleet of R.O.K. Navy and the police authorities were required. The reason for this seems to come from the fact that Dokdo island is guarded by police force same as the mainland, and the surrounding seas are guarded by the R.O.K. Navy. Also, on the point of view of the international law, the International Civil Aviation Organization(ICAO) describes that to fly a drone over Dokdo island(which is obviously a Korean territory), what you only need is Korean government's approval. Furthermore, the airspace of the two countries cannot overlap, so is there any reason to obtain permission from Japan to fly a drone over Korea's territory?

I would like to know why this kind of error happened to be described on your platform and service. If you have read this letter and confirmed that there are errors in the platform and the service, please modify them to correct information.

The news article I have mentioned above tells that after the Korea Institute of Aviation Safety Technology(KISAT) have found this error, the organization even says that it suspects there was influence from the Japanese government upon the matter. I believe it as a enough reasonable doubt because your company AirMap, in particular, has a branch in Japan and is a company invested with Japanese capital.

If this error on the service is provided constantly by AirMap, the worldwide well-known drone software, this is a huge mistake. This can be a big problem in the future for the image and the credibility your company provides. I know that many Koreans and drone enthusiasts have already been shocked after reading the article dealing with this issue as the mentioned one above, are upset about this obvious error, and are raising concerns.

I am not a public official working for the Korean government, and I am just writing this letter as a civilian and from the standpoint of someone learning about drones. In fact, personally, this is not my first time that I have found and rectified an obvious error about Korea. A map used in an article published by the BBC last summer provided an obvious error regarding Dokdo, the same island mentioned above. Despite the obvious errors, the source of the map stated, was the Ministry of Defense and the Ministry of Oceans and Fisheries of the Republic of Korea, and the error was later rectified by my letter provided with reasonable grounds. 지난주에 한국 뉴스를 보면서 귀하의 앱 “AirMap for Drones"에 관한 기사를 우연히 접하게 되었습니다. 저는 이 뉴스의 소재를 보고 놀랐고 실망을 감출 수가 없었습니다. 뉴스의 주 소재는 한국의 섬인 독도(북위 37°14′31″, 131°51′52″ 동경) 에 관해 에어맵이 제공하는 오류에 관한 것이었습니다. 만약 귀하께서 ‘독도’와 위의 좌표를 "AirMap for Drones" 앱에 검색하시면 '규칙/권고사항‘ 텝은 독도가 대한민국 영토에 해당하는데도 불구하고 (독도에서) 드론을 날리려고 하는 사람은 반드시 일본의 드론 비행 가능 지역에 대한 정보를 찾아야 하고 확인해야 한다고 되어 있습니다.

상식적으로 보아도 이것은 명백한 오류입니다. 대한민국의 영토의 상공인 영공에서 드론을 띄우는데 일본의 자료를 반드시 확인하고 일본 정부의 승인을 받아야 한다는 것은 도무지 이해할 수 없는 부분입니다. 한국의 영공은 독도 지역을 포함하고 있습니다. 대한민국 헌법 제3조에 의하면 ‘대한민국의 영토는 한반도와 그 부속도서로 한다.’라고 되어있습니다. 독도의 상공이 한국의 주권 안에 포함되는 것은 의심의 여지가 없는 사실입니다. 그러므로 저는 귀하의 앱에서 제시한 내용들이 귀 회사와 상품이 대한민국의 영역 주권을 인정하지 않는 것처럼 보일 수 있기에 매우 우려스럽습니다.

한국에서 드론을 운용할 때 참고해야 할 한국의 법과 규정을 찾아보았을 때도, 독도에서 드론을 띄우기 위해서는 대한민국 해군1함대사령부의 허가와 대한민국 경찰당국의 승인만 받으면 된다고 되어 있었습니다. 그 이유는 아마도 독도는 본토와 마찬가지로 경찰들이 보호하고 있고, 독도를 둘러싼 바다는 대한민국 해군이 보호하고 있다는 사실에 근거하기 때문인 것 같습니다. 또한 국제법적인 관점에서 보았을 때도, 국제민간항공기구(ICAO)에서도 (명백히 한국의 영토인) 독도에서 드론을 날리기 위해서는 한국 정부의 승인이 필요하다고만 안내하고 있습니다. 나아가 두 국가의 영공이 겹칠 수도 없는 노릇인데 한국의 영토 위에 드론을 띄우는데 일본 정부의 허락을 받아야할 이유가 있는지도 궁금합니다.

저는 귀하의 플랫폼과 서비스에 왜 이러한 오류가 발생했는지에 대해서 알고 싶습니다. 귀하께서 이 서한을 일고 난 후 이에 관한 오류가 있다는 것을 확인했다면 이 오류를 올바른 정보로 수정해주시길 바랍니다.

제가 앞에서 언급한 기사에서는 한국항공안전기술원이 이 문제를 발견한 후 기술원 측은 일본 정부의 입김이 있었을 것으로 추정하고 있다고 까지 말하고 있습니다. 특히 에어맵은 일본에 지사가 있고, 일본 자본이 투자된 회사이기에 충분히 할 수 있는 합리적인 의심이라고 생각합니다.

만약 전 세계적으로 잘 알려진 드론 소프트웨어 회사인 에어맵이 제공하는 서비스에 이 오류가 지속적으로 포함되어 있다면 이는 큰 실수입니다. 이 문제는 향후 귀하의 회사가 제공하는 이미지와 신뢰도에 큰 문제가 될 수도 있습니다. 저는 이미 많은 한국인들과 드론 애호가들이 이 앞서 언급한 이슈에 대한 기사를 읽고 충격을 받았으며, 이 명백한 오류에 화가 났으며, 문제 제기를 하고 있는 것으로 알고 있습니다.

저는 한국 정부에 소속된 공무원도 아니고, 그냥 한 민간인으로서, 그리고 드론에 대해 배워가는 한 사람의 입장에서 이 서한을 작성하고 있습니다. 사실 개인적으로 제가 한국에 관한 명백한 오류를 찾고 시정한 것이 이번이 처음이 아닙니다. 작년 여름에 BBC에서 발행했던 기사에 사용한 한 지도가 위와 같은 섬인 독도에 관한 명백한 오류를 포함하고 있었습니다. 명백한 오류가 있음에도 불구하고 지도의 출처를 대한민국 국방부와 해양수산부라고 했었고, 저는 그에 대해 정당한 근거를 제시한 서한을 보내서 오류를 시정한 바가 있습니다. 그 사건에 관해서는 아래 기사를 참고하시면 됩니다.
